All purchases made on this website are direct transactions between you and PINE DREAM LLC, trading as Smarticott. Shopify provides the ecommerce platform but is not the seller of record and does not process refunds or handle order fulfillment.

You must be at least the age of majority in your jurisdiction (or have your guardian’s permission) to use the Services. You are responsible for maintaining the security of your account and ensuring that all information provided is accurate, complete, and up to date.

 

 

2 – Our Products and Legal Warnings

 We reserve the right to limit quantities or discontinue products at any time.

Statutory Warranty (EU, UK, CH, CA, AU):

If you reside in the EU, UK, Switzerland, Canada, or Australia, you are entitled to statutory rights concerning product conformity. This includes the right to a free repair, replacement, or refund in the event of faulty or misdescribed products, regardless of our commercial refund policy.

 

 

3 – Orders and Contract Formation

Your order is an offer to purchase products from us. A legally binding contract is formed only once payment is processed and you receive an order confirmation email. This email will include:

  • Order number

  • Products purchased

  • Total price paid (including applicable taxes)

  • Estimated delivery timeframe

Prices are displayed in your local currency where applicable. Taxes (such as VAT) and duties are included at checkout where required by law.

If additional import duties apply in your jurisdiction, you are responsible for them unless otherwise indicated.

All transactions are solely between you and PINE DREAM LLC. Shopify facilitates checkout but is not responsible for product delivery, refunds, or customer service.

We reserve the right to cancel orders for reasons including but not limited to:

  • Suspected fraud or unauthorized payment

  • Pricing or product listing errors

  • Legal restrictions on sale or delivery

  • Stock limitations

You will be notified of any cancellation and issued a full refund if applicable.

Products are sold for personal use only and may not be resold or exported without prior written permission.

 

 

3A – Right of Withdrawal (EU, UK, Switzerland)

If you are a consumer residing in the EU, UK, or Switzerland, you have the right to withdraw from your purchase within 14 calendar days of the day after you receive your order, without giving any reason.

To exercise your right of withdrawal, contact us at hello@smarticott.com before the 14-day period expires. Please include your order number and identify the products you wish to return.

You are responsible for returning the products in their original, unopened condition. We will refund the full purchase price, including standard delivery charges, within 14 days of receiving the returned goods or valid proof of return.

This right does not apply to:

  • Products that have been unsealed and are not suitable for return due to health protection or hygiene reasons

  • Custom or personalized products

You may (but are not required to) use the standard EU withdrawal form.

4 – Prices and Billing

Prices are shown in the applicable currency. Taxes, shipping, and any import duties are calculated at checkout.

  • EU/UK customers: Prices include VAT where required

  • Non-EU customers: Duties or taxes may be charged by your local authorities upon delivery

Displayed local currency values are estimates. Final billing may be processed in USD depending on your payment provider.

You agree to provide accurate billing information and confirm that you are authorized to use the selected payment method.

 

 

5 – Shipping and Delivery

Delivery times are estimates and are not guaranteed unless explicitly stated during checkout.

Risk of loss transfers to you upon handover of goods to the shipping carrier.

We are not liable for delivery delays caused by customs processing, weather events, carrier issues, or other force majeure events beyond our control.

Please ensure your shipping details are accurate. If a parcel is returned due to incorrect address information, we reserve the right to charge for re-shipment.

 

 

6 – Intellectual Property

All content is owned by Smarticott, our licensors, or Shopify. You may use it only for personal, non-commercial purposes. Unauthorized use may lead to legal action.

Smarticott is powered by Shopify. Shopify provides the ecommerce platform but is not involved in product creation, fulfillment, or customer support.

All purchases are exclusively between you and PINE DREAM LLC.

Failure to enforce a right is not a waiver. These Terms are the complete agreement unless local consumer law states otherwise.

You may not assign your rights without our consent. We may assign our rights at any time.

 

 

21 – Governing Law and International Consumer Rights

These Terms are governed by the laws of the State of Wyoming, United States.

However, if you reside in the EU, UK, Switzerland, Canada, or Australia, you are entitled to:

  • Consumer rights and protections under your local law

  • Legal remedies available in your country

  • The right to bring claims in your country of residence

  • A 14-day cooling-off period (see Section 3A)

  • Dispute resolution via the European Commission’s ODR platform

In Australia, your rights under the Australian Consumer Law (ACL) remain unaffected.

Nothing in these Terms overrides your mandatory consumer protections.

Headings are for reference only and do not affect interpretation.

 

 

23 – Changes to Terms

We may update these Terms at any time. Material changes will be communicated as required by law.

Continued use of the Services means you accept the updated Terms.
